MOTIONMALL PRIVACY POLICY

Effective: December 1, 2005

MotionMall respects each individual's right to personal privacy, and we have established our information practices according to that guiding principle. We collect and use information through the MotionMall website and MotionMall advertising service only in the ways disclosed by this privacy policy.

Our privacy policy is segmented into sections in order to clearly present the information practices relevant to our three user groups:

(1) MotionMall Customers: website owners who register for the MotionMall service and place MotionMall web ads on their websites.

(2) MotionMall Web Ad Users: individuals who interact with MotionMall web ads on the websites of MotionMall customers.

(3) MotionMall Website Users: anonymous visitors to our website.

The last section of our privacy policy provides information regarding several items that are applicable to all of our user groups.


1. PRIVACY FOR MOTIONMALL CUSTOMERS

MotionMall Customers are website owners who register for the MotionMall service and place MotionMall web ads on their websites. Customers proceed through a 4-step process on our website to build customized MotionMall web ads that contain their particular display and content preferences.

Information Collection and Use of Personally Identifiable Information

We collect four pieces of personally identifiable information about each customer: (1) Amazon Associates ID, (2) Full Name, (3) Email Address, and (4) Website URL. This information is provided by the customer and is captured on our website during the web ad creation process. This information is stored directly in our computer system and is never at any time stored in a persistent cookie or session cookie. Cookies are small files that reside on a user's computer to identify them and are used by some websites to provide tailored user experiences. There are two types of cookies (persistent and session), and our website uses neither of them to capture information from our customers.

We use a customer's Amazon Associates ID in a web ad so that it has the capability of indicating that the customer is the referring party when this information is transmitted to Amazon after a web ad user clicks a product of interest. Our computer system records statistics regarding the usage of web ads primarily for the purposes of information analysis in aggregate form; however, it is possible for us to link usage statistics to an individual customer through a customer's Associates ID. Also of note is that after a web ad user arrives at a product detail page on the Amazon website, a customer's Associates ID is oftentimes visible embedded within the URL shown in the address bar of the user's browser. There is no personally identifiable information about the customer that can be publicly obtained from Amazon or MotionMall with this ID.

We use a customer's contact information (full name, email address, and website URL) to send important notices regarding the operation and features of the MotionMall advertising service on rare occasions when it is necessary to do so. A customer's contact information is never used in a web ad and is not publicly available. Generally, there is not a choice to opt-out of receiving these service-related announcements. However, if a customer does not wish to receive them, an email should be sent to info@motionmall.com requesting account deactivation.

Information Collection and Use of Non-Personally Identifiable Information

We collect a customer's display and content preferences specified during the process of creating a web ad. This information is used by a web ad to render itself as intended by the customer on the customer's website.

Our computer system automatically receives and records information in our server logs for each load of a web ad such as date/time stamp, source IP address, web ad served, browser type, and operating system. This information is used in aggregate form to analyze web ad usage primarily in an effort to understand trends regarding display and content preferences.

We collect various types of non-personally identifiable information about our customers during their interactions with our website. Our computer system automatically receives and records information in our server logs for each page visit such as date/time stamp, source IP address, web page served, browser type, operating system, and referring web page. This information is used in aggregate form to analyze website usage, administer the website, understand usage and navigation trends, and determine the relevance of content.

We do not use cookies of any type (persistent or session) or web beacons (also called web bugs, pixel tags or clear GIFs) to collect non-personally identifiable information. Cookies are small files that reside on a user's computer to identify them, and web beacons are small transparent graphic images that monitor the behavior of users.

Information Sharing and Disclosure

We do not rent or sell any personally identifiable information about customers to third parties. However, we may share personally identifiable information with a third party when we believe release is appropriate to: (1) respond to a subpoena or otherwise comply with the law, (2) investigate, prevent, or take action regarding illegal activities, suspected fraud, or situations involving potential threats to the physical safety of any person, (3) exercise our legal rights or defend ourselves against legal claims, or (4) enforce or apply our Terms of Service.

Information Access

If a customer's Amazon Associates ID changes, the customer must proceed through the 4-step process to create another web ad with the new Associates ID. If a customer's contact information (full name, email address, or website URL) changes, this information can be modified by sending an email to info@motionmall.com. We will take reasonable steps to verify a customer's identity before making any changes to contact information.

Information Security

To prevent unauthorized access, maintain data security, and ensure the correct use of personal information, we have put in place generally accepted industry standard physical, electronic, and operational procedures to safeguard the personal information collected. However, no method of electronic storage is 100% secure. Therefore, while we strive to use commercially acceptable means to protect personal information, we cannot guarantee its absolute security.

Business Transition

In the event MotionMall goes through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of its assets, our personally identifiable information of our customers likely will be among the assets transferred. Customers will be notified via email of any such change in ownership or control of personal information.


2. PRIVACY FOR MOTIONMALL WEB AD USERS

MotionMall Web Ad Users are individuals who interact with MotionMall web ads on the websites of MotionMall customers.

Information Collection and Use

We do not collect any personally identifiable information about web ad users. However, we do collect various types of non-personally identifiable information about web ad users during their interactions with web ads.

Our computer system automatically receives and records information in our server logs for each load of a web ad such as date/time stamp, source IP address, web ad served, browser type, and operating system. In addition, our computer system automatically receives and records information in our server logs for each click within a web ad such as date/time stamp, source IP address, click type, browser type, and operating system. This information is used in aggregate form to analyze web ad usage, administer web ads, understand usage and navigation trends, and determine the relevance of content.

We do not use cookies of any type (persistent or session) or web beacons (also called web bugs, pixel tags or clear GIFs) to collect non-personally identifiable information. Cookies are small files that reside on a user's computer to identify them, and web beacons are small transparent graphic images that monitor the behavior of users.

When a web ad user clicks a product of interest in a web ad, the user is presented with a product detail page on the Amazon website. If the web ad user purchases the product of interest or any other qualifying product on the Amazon website within 24 hours, Amazon pays a commission to the referring party (either the MotionMall customer or MotionMall). Amazon provides the referring party with access to general information relating to the product purchase (date/time stamp, item and price) but does not make available any personal information about the web ad user.


3. PRIVACY FOR MOTIONMALL WEBSITE USERS

MotionMall Website Users are anonymous visitors to our website.

We do not collect any personally identifiable information about website users. However, we do collect various types of non-personally identifiable information about website users during their interactions with our website.

Our website and web ads contain links to other websites that are not owned or controlled by MotionMall. Please be aware that MotionMall is not responsible for the privacy practices of such other websites. We encourage users to be aware when leaving our website or web ads and to read the privacy policies of each and every website that collects personally identifiable information. This privacy policy applies only to information collected through our website and web ads.

Changes to this Privacy Policy

If we decide to change our privacy policy, we will post the changes here and other places we deem appropriate to disclose our information practices. We reserve the right to modify this privacy policy at any time, so please review it frequently. If we make material changes to this policy, we will provide notice to our customers via email regarding the changes.

Safeguarding Children

The Children's Online Privacy and Protection Act, 15 U.S.C. § 6501 et seq. ("COPPA"), limits what type of information can be used and disclosed after being collected online from minors. Our website and web ads are generally directed at persons over the age of 13 who purchase items with credit cards, and we do not knowingly collect personal information from or about children under the age of 13. If at any time we learn that we have obtained information relating to a child under the age of 13, we shall immediately purge such information from our records.
